2. Description of Service

Momently.photos allows users to:

• upload photos;
• generate short motion-enhanced videos from those photos;
• combine multiple clips into a single memory video;
• download the final output.

Momently.photos does not:

• restore, edit, or permanently modify the original image;
• create deepfakes or change facial expressions;
• store user photos permanently.

We reserve the right to update, modify, or discontinue features at any time.

3. User Content

When you upload photos or other materials ("User Content"), you confirm that:

• you own the rights to the content, or
• you have permission to use and upload it.

You retain full ownership of your User Content.

By uploading, you grant Momently.photos a temporary, non-exclusive license to process your content solely for the purpose of generating your video.

We do not sell, share, or use your photos for training AI models.

All uploaded content is automatically deleted from our systems after processing, except for temporary caching required for delivery.

4. Prohibited Content

You may not upload content that includes:

• nudity or sexual content
• violence or harm
• hateful, abusive, or discriminatory imagery
• copyrighted images you do not own
• illegal, dangerous, or misleading content
• personal information of someone without their consent
• photos of minors you do not have permission to upload

If any of these appear in your content, your video generation may fail and your access may be restricted.

5. Payments & Subscription

Momently.photos offers both one-time purchases and subscription plans.

By purchasing:

• you agree to the listed pricing at the time of checkout,
• you authorize us or our payment provider (e.g., Stripe) to charge your payment method.

Subscriptions

• You will be billed automatically each billing cycle (monthly or yearly).
• You can cancel at any time through your account settings.
• After cancellation, you retain access until the end of the current billing period.
• We do not provide partial refunds for unused subscription time.

One-time purchases

• These are single transactions and do not renew.
• All sales are final unless otherwise required by law.

6. Refund Policy

Because our processing uses computing resources and produces immediate digital output, we generally do not offer refunds.

Refunds may be granted if:

• your video repeatedly fails due to a system error, or
• you were charged incorrectly.

7. Privacy

Your privacy is extremely important to us.

• Uploaded photos are used only to generate your video.
• Photos are automatically deleted after processing.
• We do not use user content to train models.
• Only essential metadata (file type, timestamps, usage) is stored for service operation.

8. AI Output

All outputs are generated by AI.

You understand and agree that:

• results may vary depending on the input;
• AI cannot guarantee perfect accuracy, realism, or alignment with your expectations;
• occasional visual artifacts may occur due to limitations of current technology.

Momently.photos is not responsible for unexpected visual outcomes or interpretations of the generated content.

9. Acceptable Use

You agree not to:

• misuse the service in any harmful way
• attempt to reverse-engineer or interfere with the system
• violate copyright or privacy laws
• upload prohibited content (Section 4)

We may suspend or terminate accounts violating these rules.

10. Intellectual Property

The Momently.photos platform, branding, website, code, design, and all related content are owned by Momently.photos and protected by copyright and trademark laws.

You may not copy, reproduce, or resell any part of the Service.

11. Limitation of Liability

To the fullest extent permitted by law:

Momently.photos is not liable for:

• loss of data
• inaccuracies in AI-generated output
• service interruptions
• user-uploaded content
• damages resulting from misuse of the Service

Your use of the Service is at your own risk.
